This privacy statement covers the processing of personal data by Fenix Consulting NV, with registered office at Coremansstraat 34, 2600 Berchem and registered in the Crossroads Bank for Enterprises under number 0870.628.448 .

Fenix Consulting NV collects personal data of clients, participants, suppliers and visitors to our website. Fenix Consulting NV declares that, as Controller of the Processing, it complies with Belgian privacy legislation as well as the provisions of the General Data Protection Regulation as of its entry into force.

The General Data Protection Regulation (AVG) , also known as GDPR (General Data Protection Regulation), is European legislation that has direct effect within the European Economic Area. As of May 25, 2018, this regulation replaces the Act of December 8, 1992 for the protection of privacy with respect to the processing of personal data

What personal data are processed by us?

Processing of personal data includes the collection, storage, recording, alteration, collection, retrieval, consultation or destruction of personal data.

  2. Your job title
  3. Your company
  4. Any other data you provide to us in connection with the purposes described below in point 4

  1. The identity information you provide to us such as your first name, surname, address, mailing address, phone number
  2. Your resume
  3. At assessment center / development center / screening: video and audio recording for internal validation of observations
  4. Any other data you provide to us in connection with the purposes described below in point 4

3.3. Through our website:

  1. Without registration: your IP address
  2. When completing the contact form on our website: first name, last name, e-mail address, phone number, company name.

4. For what purposes do we process your personal data?

Fenix Consulting NV collects personal data for a variety of purposes.

4.2. General purposes as a (potential) customer or supplier

4.2.1. Provision of (pre-)contractual services.

Fenix Consulting NV processes your personal data in order to provide our services to you. For example, we use the data to make an offer at your request and then execute the agreement, to maintain the relationship with you in relation to the assignment, and to send an invoice. We also use the data to answer requests for information. The legal basis for providing (pre-)contractual services is the maintenance of a contractual relationship and the formation or performance of an agreement or contract.

4.3.1. Provision of services

  • Development Centers
  • Coaching
  • Training
  • Screening
  • Online Testing and Serious Games

The legal basis for processing your personal data for these purposes is your express and explicit consent, which you may also withdraw at any time.

4.3.2. Involvement of and sharing with third parties

Fenix Consulting NV, as Controller, may engage other parties to perform an aspect or part of the services for you; this may include, for example, an external consultant, trainer or assessment psychologist, or an external test(system) as part of the assessment, or ICT system or platform through which we perform our services, for example, a crm system or e-learning platform. To the extent these third parties need access to personal data to perform these services, Fenix Consulting NV has contracted appropriate contractual, technical and organizational security measures to ensure that these third parties only use or process your data for the intended purposes and in accordance with the instructions we have agreed with these third parties.

Furthermore, your personal data will also be shared with the client of the assessment or research you are going through with us.

4.4.1. Processing of your data on the website

We collect and use your personal data on our website to provide you with (personalized) web content and to communicate with you in the most targeted way possible. 5. Retention periods

Fenix Consulting NV does not store your personal data for longer than is necessary for the purposes for which the data was collected. The retention period depends on the nature of the information and the purposes of the processing. Below we list the retention periods of personal data for different purposes and services.

  • Your development report: 2 years
  • Your coaching report: 2 years.
  • Your training data: 2 years
  • Your screening data: 2 years
  • Your results from e-tests or serious games: 2 years
  • At Online assessment / development center / screening: video and audio recording: 5 working days

Inclusion in our talent pool: as long as needed

Your personal data will also be further stored in accordance with possible legally required time limits (e.g. accounting) and any statutes of limitation that may apply.

6. Rights

The following rights with respect to personal data are exercisable upon written request.

6.2. Right of access and inspection

You have the right to know about your personal data at any time, free of charge, as well as about the use we make of your personal data in accordance with the provisions in force in the sector.

6.3. Right of rectification, deletion and restriction
